What is mediation?

Mediation

Divorce is sometimes unavoidable. Sometimes it will be devastating for one or both of the parties involved, but sometimes it is liberating. In almost every case there will be very much emotion, stress and cost involved. Even in amicable separations it is possible for the divorce process to sour relations and create conflict, rather than resolve conflict.

The question often posed is whether there is such a thing as “a good divorce?” William Giles is a specialist family law Solicitor of 25 years’ experience. He recognises that the process of divorce can be expensive, emotional and stressful. It can be distressing and destabilising for both parents and children.

What is mediation?

Mediation is a process of often round table meetings where a couple with the assistance of a Mediator seek to reach agreement between themselves as to issues arising from divorce and separation.

The Mediator is neutral, meaning that the Mediator does not give advice to each party about what their best interests are, although the Mediator will always have the children’s best interests in mind.

The Mediator is impartial, that is the Mediator is not a Judge. The Mediator does not make the decision. The Mediator facilitates the couples’ discussions in order that they can agree matters between themselves.

The mediation is confidential. It cannot be referred to in later Court proceedings where the couple do not reach an agreement.

Mediation is voluntary. Couples do not have to attend mediation, although where one of them wants to apply to Court they must attend a mediation information and assessment meeting.
