Mediation

Divorce is sometimes unavoidable.  Sometimes it will be devastating for one or both of the parties involved, but sometimes it is liberating.  In almost every case there will be very much emotion, stress and cost involved.  Even in amicable separations it is possible for the divorce process to sour relations and create conflict, rather than resolve conflict.

The question often posed is whether there is such a thing as “a good divorce?”  William Giles is a specialist family law Solicitor of 25 years’ experience.  He recognises that the process of divorce can be expensive, emotional and stressful.  It can be distressing and de-stabilising for both parents and children.

What mediation is not

Mediation does not necessarily lead to an Order, particularly in discussions concerning children.  It may well lead to an agreement being reached between a couple as to how they will parent their children and how much time each will spend with the children.

Mediation is not about reconciliation.  Mediation is about resolving financial and children issues without proceeding to Court.

The Mediator is not a Judge.  The Mediator does not make the decision.  The parties make the decision.  The parties reach agreement with the assistance of the Mediator.  The Mediator has expertise in judging the parties’ emotions and identifying the key issues for them.

Mediators do not look for the parties’ “positions”.  They try to find a common ground and what the parties’ interests are.
