Divorce is sometimes unavoidable.  Sometimes it will be devastating for one or both of the parties involved, but sometimes it is liberating.  In almost every case there will be very much emotion, stress and cost involved.  Even in amicable separations it is possible for the divorce process to sour relations and create conflict, rather than resolve conflict.

The question often posed is whether there is such a thing as “a good divorce?”  William Giles is a specialist family law Solicitor of 25 years’ experience.  He recognises that the process of divorce can be expensive, emotional and stressful.  It can be distressing and destabilising for both parents and children.

Negotiations between Solicitors

This is a process by which a couple appoints Solicitors to act on their behalf in regard to the issues arising from the breakdown of their relationship.

The Solicitors will use a variety of methods, such as round table meetings, direct conversations over the telephone or in person and letters in order to try and reach a solution and avoid Court proceedings.

The first stage of the process will be to gather information, known as full and frank disclosure.  This will include details of the parties’ income, expenditure, assets, debts and liabilities.

Many cases are concluded by Solicitors negotiating agreements in this way.  This often avoids Court proceedings.  At the successful conclusion of an agreement between the Solicitors on behalf of their clients, in financial issues a Consent Order will be filed at Court for the Court to approve and in children cases an agreement will be reached in correspondence.
